H&S Appointed Competent Persons

Published on 17 September 2021 at 22:08
Any business with five or more employees in the UK is legally required to have:
  • A health and safety policy
  • A risk assessment which covers all significant workplace hazards
  • An appointed competent H&S person to provide health & safety advice, either internally or through an external consultant
  • A health and safety manual or set of processes which details the planning, implementation, monitoring and evaluation of all health and safety arrangements in the workplace
  • Sufficient training for all employees
Some businesses can appoint a competent person internally (who has sufficient H&S training and experience), although there are many smaller businesses out there who cannot.

There are numerous penalties for failing to comply with the law including unlimited fines, director disqualifications and HSE fees for intervention, which can send a small business under.
